FBI’s Use of Surveillance Equipment Raises Privacy Concerns

Should the FBI be allowed to place GPS surveillance devices on peoples’ cars without their knowledge?

Yassir Afifi, a resident of California, found out the hard way that the FBI can use GPS devices to track people – without obtaining a search warrant.

When Afifi took his car in for an oil change, his mechanic discovered a black rectangular device attached to it. Afifi posted pictures of the device on an online forum, and several people identified it as a GPS tracking device.

Shortly after, FBI agents visited his house and demanded their surveillance equipment back.

9th Circuit Court of Appeals Says GPS Tracking Devices Are Permissible

Afifi doesn’t understand why the FBI was allowed to put a tracking device on his car without his knowledge, or why they were targeting him in the first place.

The FBI says that using GPS tracking is the electronic version of the physical surveillance they ordinarily do to gather investigative information. The FBI ordinarily tails people to track their activities. With today’s technology, they can monitor them using GPS.

Civil rights groups consider the FBI’s use of GPS tracking devices to be intrusive. However, in January of this year, the 9th U.S. Circuit Court of Appeals ruled that it is permissible for law enforcement agents to attach GPS devices to vehicles without search warrants.

This does not mean that law enforcement agencies are allowed to use any and all types of surveillance equipment without obtaining warrants. However, GPS devices are allowed – at least for now.

Afifi Isn’t the First to be Targeted by GPS Tracking

Once Afifi’s story became public knowledge, he learned that he was not the only one the FBI was tacking using GPS. Another Northern California man, Abdo Alwareeth, found a GPS device on his car two years ago.

He is still trying to gather information and find out why he was targeted by the FBI, and why they were allowed to track him without his knowledge. He hasn’t had any success with the complaints he has filed. Instead, he and his wife check under their cars every day for tracking devices.

Afifi’s case has raised several privacy concerns. The FBI maintains that keeping tabs on people is an essential part of a law enforcement official’s job. In addition, the surveillance equipment they are using does not have video capabilities, so a certain level of privacy is still maintained.

However, by simply tracking someone’s everyday activities you can still learn a great deal about them. And for these two men who realized they were being followed 24 hours a day, their idea of privacy will forever be shattered.

A Cincinnati woman was stalked for four months by phone before she was able to help police identify the man behind the threatening phone calls. To protect herself Laurie Russo installed surveillance equipment in her home, reinforced all her windows and used deadbolts every evening. The police learned that the phone calls were usually coming from local gas stations, but by the time they arrived the stalker was always gone.

Russo took matters into her own hands and made a spreadsheet of the incoming phone calls and their corresponding gas stations. Every time she got a call she immediately phoned the gas station to see if the workers could see anyone. It finally worked and a gas station worked was able to get the license plate of the man on the premises at the time a call was made to Russo’s house. Surveillance equipment viewed later showed the perpetrator using a pay phone at the exact moment Russo received the call.

 As for her stalker, Russo says she has “no idea” how she became a target. But the police – and even the judge on the case – said they were thankful for her help, Russo said. And she said she’s grateful for their work, too.
“They couldn’t have done more for me, patrolling the street more and just being there,” she said.

Thanks to Russo’s smart thinking and the gas station’s well-placed security cameras, Thomas McComas is now behind bars and Russo can finally sleep soundly.

I mean i can Earthgoogle my house and recognize it and my car sitting outside in the drive way, wouldn’t you think that a so called security “surveillance” mounted a few feet away or above a suspect let’s say, in a store or bank robbery or something, be advanced enough to produce a “kodak” clear picture?…I’ve never seen one on television, at least, that would ever help me recognize anybody, Is the problem that i AM seeing it on television? i’m really confused about the effectiveness and seemingly lack of technology in these cameras…

It is because the lenses are bot as good as you would find at say a TV studio. Most of those are built rugged, for long use, not necessarily for crystal clear pictures. You can’t get a great picture with a bad lens, no matter how closer you are to it.

The Ohio Homeland Security Agency wants to create a massive network that will link thousands of surveillance cameras located all across the state. This network would include cameras that are monitoring public roads and schools as well as privately owned business such as shopping malls.

The goal is to provide a better way for first responders such as police office and firefighters to respond to major emergencies. By linking up so many surveillance cameras, first responders would be able to get a more comprehensive understanding of each emergency, allowing them to devise more efficient ways to handle the situation.

The system is similar to one that already exists in Alabama, and the plan is to have it up and operating within the next two years. A total of 5,000 was approved for the project last month.

Ohioans Have Mixed Opinions about Surveillance Camera Network

Some Ohioans see this massive surveillance system as a violation of their privacy and a “Big Brother” attempt to spy on them.

However, the surveillance cameras that will be linked into the network already exist. The activities of people on the roads and in the schools and businesses are already being monitored. The only difference is that now all these cameras will be linked together within one network.

Although no specific plans have been released, it would make sense that all the cameras will be monitored under one operating system. This would allow first response team members to locate an emergency situation as quickly as possible – even if the monitoring cameras are not within their immediate surveillance area.
